1. Who We Are

ShipShape & Co. Limited (NZBN 9429053716934, "ShipShape & Co.", "we", "us", "our") provides boat launch, retrieval, and cleaning services to members of the Outboard Boating Club (OBC), Parnell, Auckland, New Zealand. By creating an account, making a booking, purchasing a 10-Launch Bundle, or otherwise using our services, you ("you", "the Customer") agree to be bound by these Terms in their entirety.

If you are booking on behalf of a company or other entity, you confirm you have authority to bind that entity to these Terms. We may decline any booking at our discretion.

2. Eligibility & Membership

Our services are available to current members of the OBC. At registration, you'll tell us whether you're a Hardstand Member or a General Member:

  • Hardstand Members can book both Launch & Retrieval and Cleaning.
  • General Members can currently book Cleaning only. Launch & Retrieval is not yet available to General Members; we hope to extend this in future and will let you know if that changes.

You must hold a valid OBC membership of the relevant type to register an account and book services. If your membership type changes, please let us know so we can update your account.

3. Services

Launch & Retrieval. We launch and retrieve your boat using the OBC's boat-lifting equipment, ramp, or associated facilities (including trailer rinse, automatic boat wash, and motor rinse). Launching and retrieval carries inherent risk to your boat, and our liability is limited as set out in section 9. We exercise reasonable care and skill, but can't guarantee against damage caused by unforeseen conditions, pre-existing defects in your boat's hull or fittings, or anything outside our reasonable control. We may decline to launch or retrieve a boat we reasonably consider unsafe or unsuitable.

Cleaning. We offer The Refresh and Full Detail cleaning tiers (priced by boat length), and premium services such as Cut & Polish (quoted individually). Cleaning is available to all members, at the OBC or, for General Members, at home.

We may add new services from time to time. These will be reflected on our website and governed by these Terms.

4. Bookings & Boat Requirements

Bookings are made through your account dashboard, by phone, or by email, and are pending until we confirm them. We'll make reasonable efforts to deliver services at the agreed time, but times are estimates — we're not liable for delay caused by weather, equipment availability, OBC operational requirements, or anything else outside our reasonable control. We may reschedule a booking for these reasons and will give as much notice as we reasonably can. You must give us clear, safe access to your boat at the agreed time.

For Launch & Retrieval bookings specifically, before each scheduled launch you confirm that:

  • Your boat keys will be accessible in the OBC lockbox.
  • Your boat has a minimum of 3 dock lines on board.
  • Fenders are on board.
  • Your trailer has a current Warrant of Fitness (WoF).
  • Your boat has passed OBC inspection.
  • The bilge pump is operational.
  • Any known issues with your boat or trailer are noted in your boat profile.

We may decline or delay a Launch & Retrieval booking if these requirements are not met, or if attempting the service would be unsafe.

5. The 10-Launch Bundle

The 10-Launch Bundle is a pre-paid package of 10 Launch & Retrieval credits for $990 (incl. GST), valid for 3 years from the date of purchase. Bundle credits are linked to your customer account, not to a specific boat, and remain usable on any boat registered to your account, even if a boat is later removed from your account.

We keep the authoritative record of Bundle credits purchased, used, and remaining. If there's ever a discrepancy with your own records, our records will prevail in the absence of a clear error — you can ask us for a statement of your Bundle credits at any time. Credits not used within the 3-year validity period lapse automatically and are not refundable, except where we cancel a booked service (see section 4).

If we permanently stop providing Launch & Retrieval services at the OBC before your Bundle's validity period expires, we'll refund you a pro-rata amount: (remaining credits ÷ 10) × $990 (excl. GST). This is our only obligation to you in that situation.

6. Pricing & Payment

All prices shown on our website include GST and are current at the time of booking. Current pricing includes the 10-Launch Bundle ($990, prepaid, valid 3 years from purchase), Casual Launch ($125 per launch), and Cleaning (The Refresh from $45/m, Full Detail from $65/m, $199 minimum). The following surcharges may apply: short notice booking (less than 48 hours) +$50, card payment +2.5%, and standalone cleaning booked without a launch or retrieval +$49.

Payment is due at the time of booking. Card payments are processed immediately through our payment provider, Stripe. Bank transfer payments must be completed promptly using the reference provided when your booking is confirmed — we reserve the right to cancel a booking if payment is not received in time for the scheduled service.

We may decline to take future bookings from a customer with a history of late or failed payment.

7. Cancellations & Rescheduling

This section applies to all bookings, whether paid for individually or using a Bundle credit. Cancellations or changes made before midday (12pm) on the day before your scheduled launch are fully refunded or, for Bundle bookings, the credit is returned to your account with no penalty. Cancellations or changes made after that cut-off are not refunded, and any Bundle credit used for that booking is not returned, except where we are the one cancelling or rescheduling the booking.

If something genuinely unexpected comes up after the cut-off, contact us and we'll do what we reasonably can to help — but this isn't guaranteed. We may update this policy from time to time, in which case this section will be updated.

8. Pre-Service Inspection & Customer Disclosure

We take before-and-after photos of your boat as part of our Cleaning and Launch & Retrieval process, for quality control and to resolve any disputes about condition. These photos and records form part of your boat's service history and are retained as described in our Privacy Policy.

You must tell us about any known defects, fragile fittings, or custom installations that might affect how we carry out a service — we're not liable for damage arising from your failure to disclose this. If we identify, before starting a service, a condition that in our reasonable opinion makes your boat unsuitable, or creates an unacceptable risk of damage, we may decline to proceed without liability. If this happens for a Bundle booking, the credit is returned to your account.

9. Liability

We take reasonable care of your boat and trailer while they are in our care during a launch, retrieval, or cleaning service, and we are liable for loss or damage caused by our own negligence.

We are not liable for: pre-existing damage or wear to your boat or trailer; issues arising from equipment you supply that does not meet the requirements in section 4 (for example, an unroadworthy trailer or missing dock lines); damage caused by your boat's own mechanical, structural, or electrical failure; or events outside our reasonable control, including adverse weather or OBC facility issues.

Where we are liable to you for loss of or damage to your boat or trailer, our total liability for that claim is capped at NZD $500,000 per incident, reflecting the level of public liability cover we hold for this risk, except where a higher amount cannot lawfully be excluded. This cap is fixed and does not depend on the outcome of any particular insurance claim. We are not liable for indirect or consequential loss, including loss of use of your boat or loss of charter or hire income.

Nothing in these Terms limits or excludes any rights or remedies you have under the Consumer Guarantees Act 1993 that cannot lawfully be excluded, or any liability for death or personal injury caused by our negligence or fraud. If you are acquiring our services for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply to that supply, to the extent permitted by section 43 of that Act.

If you believe we've caused damage, please tell us in writing as soon as reasonably practicable, and in any event within 7 days of the service, or within 7 days of you becoming aware of the damage — whichever is later. Please give us a reasonable opportunity to inspect the damage before any repair work begins, as this helps us assess the claim fairly and quickly.

We recommend you maintain your own insurance cover for your boat and trailer, and that you let your insurer know a third-party service provider (us) will be working on and handling your boat from time to time. We hold public liability insurance and will provide evidence of this on reasonable written request. We do not hold marine or hull insurance on your behalf.

10. Environmental & Biosecurity Compliance

We use cleaning products that comply with New Zealand environmental regulations and OBC requirements, and take reasonable steps to contain and properly dispose of wastewater from cleaning activities. You must not ask us to use products or methods that would breach any OBC rule, Auckland Council bylaw, or New Zealand law relating to marine pollution, biosecurity, or environmental protection.

New Zealand biosecurity law places obligations on boat owners relating to marine pest management — this remains your responsibility, not ours. If we identify a notifiable marine pest or invasive organism on or near your boat during a service, we may be required by law to report this to the appropriate authority, and may need to pause the service until the matter is resolved. If this happens for a Bundle booking, the credit is returned to your account.

11. OBC Rules & Our Authority to Operate

All services are provided subject to OBC rules, bylaws, and policies as amended from time to time, and you're responsible for understanding and complying with those that apply to your boat and berth. We operate at the OBC as an approved service provider — if the OBC withdraws or suspends our authority to operate, our obligation to provide services will be suspended accordingly, and the pro-rata refund described in section 5 will apply to any affected Bundle.

12. Changes to These Terms

We may update these Terms from time to time. The current version will always be available on this page with its last-updated date. Continued use of our services after an update means you accept the revised Terms.

13. Governing Law & Disputes

These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

Before taking formal action, please contact us at jake@shipshapeandco.nz so we can try to resolve the issue directly. Claims up to $60,000 may also be brought in the Disputes Tribunal.
